Terms of Use

1. Relationship to Apple

These Terms are between you and Axis only, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

You acknowledge that:

• Apple has no obligation to provide maintenance or support services for the App
• Apple is not responsible for addressing any claims relating to the App or your use of it, including product liability, regulatory compliance, or intellectual property claims

Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

2. Eligibility

You must be at least 18 years old to use the App.

By using the App, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• Your use of the App complies with all applicable laws

3. Account Registration and Security

Certain features require account registration.

You agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activity that occurs under your account

You must notify us immediately of any unauthorized use. Axis is not liable for losses caused by unauthorized access resulting from your failure to secure your account.

4. Acceptable Use

You agree not to use the App to:

• Violate any law, regulation, or third-party right
• Harass, threaten, abuse, exploit, or harm others
• Impersonate any person or entity
• Upload or distribute malware, spyware, or harmful code
• Attempt to gain unauthorized access to systems or data
• Use the App for advertising, solicitation, or commercial purposes without written permission

Axis may remove content, suspend features, or terminate accounts at its sole discretion.

5. User Content

You may submit content including messages, posts, or other materials ("User Content").

You retain ownership of your User Content.

By submitting User Content, you grant Axis a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute such content solely to operate, maintain, and improve the App.

You are solely responsible for your User Content and represent that you have all rights necessary to submit it.

Axis does not endorse User Content and is not responsible for its accuracy, legality, or conduct of users.

6. Community and Safety Disclaimer

Axis provides communication tools only and does not supervise, verify, or control user behavior.

You acknowledge that:

• Interactions with other users occur at your own risk
• Axis is not responsible for offline meetings, disputes, injuries, or damages
• You are responsible for exercising caution and good judgment

7. Intellectual Property

All App content, software, trademarks, logos, and designs (excluding User Content) are owned by Axis or its licensors and protected by intellectual property laws.

You may not copy, modify, distribute, sell, sublicense, or reverse engineer any part of the App without prior written consent.

8. Termination

Axis may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if required for security, legal, or operational reasons.

You may stop using the App at any time.

Sections that by their nature should survive termination will survive.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE."

To the maximum extent permitted by law, Axis disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and availability.

Neither Axis nor Apple guarantees that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law:

• Axis shall not be liable for indirect, incidental, consequential, or punitive damages
• Axis's total liability shall not exceed the amount you paid to Axis in the previous twelve months, or zero if no payment was made

Apple has no liability whatsoever related to the App.

11. Indemnification

You agree to indemnify and hold harmless Axis and its affiliates from claims, damages, losses, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your User Content

12. Changes to These Terms

We may update these Terms at any time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, excluding conflict-of-law rules.
